The Federal Trade Commission has detailed an aggressive and controversial view of its Section 5 authority, now backed by its plans to issue a legally questionable competition rule on non-competes.  


At the same time, the Department of Justice and the Federal Trade Commission have been drafting revised merger guidelines that are expected to significantly alter the way the agencies approach merger reviews.
